Terms of use for Edustar Malaysia tutor-matching services.

Introduction

These Terms of Service govern your use of Edustar Malaysia's private tuition matching platform under the Contract Act 1950, the Consumer Protection Act 1999, the Personal Data Protection Act 2010 and other applicable Malaysian law. Questions about them go to edustarmy@gmail.com. Welcome to Edustar Malaysia. By accessing or using our services, you agree to be bound by these Terms of Service. Please read them carefully before using our platform. If you do not agree with these terms, please do not use our services.

1. Definitions

Terms used in this document:

"Platform"

Refers to the edustar.my website, any associated mobile applications, and all digital services operated by Edustar Malaysia.

"User"

Any individual who accesses or uses the Platform in Malaysia: learners of any age, whoever registers or pays for a learner (the learner themselves, a parent or guardian, an employer or a sponsor), and tutors.

"Services"

Private tutoring, learning support, tutor matching, and related educational services provided through the Platform across Malaysia.

"Tutor"

An independent instructor registered on the Platform to deliver private tutoring services to Users.

"Tuition Session"

A scheduled period during which a Tutor teaches a learner, whether in-person at an agreed location or online via video conferencing.

2. Terms of Use

To use Edustar Malaysia services, you must:

Age and Consent for Younger Learners

Be at least 18 years of age. A learner under 18 is registered and supervised by a parent or legal guardian, whose explicit consent covers that learner’s use of the Platform.

Accurate Information

Provide true, accurate, and complete information when registering and throughout your use of the Services, in line with honesty obligations under the Trade Descriptions Act 2011.

Account Security

Maintain the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

Legal Compliance

Comply with all applicable Malaysian laws and regulations, including the Personal Data Protection Act 2010 and any KPM directives that apply to private tuition.

3. Private Tutoring Services

Terms covering Edustar Malaysia tutoring services:

Scheduling

Session times are agreed directly between the User and the Tutor through the Platform. Cancellations or rescheduling requests should be made at least 24 hours before the agreed start time.

Session Duration

Typical session lengths are 60 minutes for primary (Tahun 1–6), 90 minutes for secondary (Tingkatan 1–5) and pre-university (Tingkatan 6 / STPM / A-Level / IB), with longer formats available for intensive SPM, IGCSE, or MUET preparation.

Mode and Location

Sessions may be delivered in-person at an agreed safe location across Malaysia (home, library, study centre) or online via video conferencing. Online sessions reach every state, and Edustar tutors teach in person across the Klang Valley, Penang, Johor and towns throughout the peninsula and East Malaysia.

Tutor Matching

We match Users with Tutors based on subject, level (UPSR transition, PT3, SPM, STPM, IGCSE, IB, MUET, university), language preference, and availability. You may request a replacement Tutor at any time, at no additional cost.

Examination Grades

Edustar tutors work toward each learner’s target grade. Results also rest on the learner’s own effort and school or course context, so Edustar Malaysia does not guarantee specific examination grades or academic outcomes.

4. Payment and Refund

Payment terms for Edustar Malaysia services:

Currency and Methods

All fees are quoted and payable in Malaysian Ringgit (MYR / RM). Accepted methods include FPX online banking, DuitNow QR, e-wallets (Touch 'n Go, GrabPay, Boost), and major credit/debit cards.

Advance Payment

Sessions and packages are payable in advance. Recurring monthly packages may be billed on a scheduled cycle agreed at sign-up.

Cancellation Notice

A lesson can be rescheduled or cancelled free of charge with at least 24 hours' notice. With less notice it can still be moved with the Tutor on request; a lesson cancelled late and not moved counts as taught, and so does a lesson the learner misses without notice after the Tutor has waited 15 minutes. No other late-cancellation charge applies. Tutors honour the same 24-hour notice period.

Refund Policy

Refunds and cancellations are governed by our Refund and Cancellation Policy, which forms part of these Terms. Every unused, paid session is refunded on request within 7 business days, with no deduction for processing fees, and sessions already delivered are non-refundable. The policy applies alongside your rights under the Consumer Protection Act 1999.

Pricing Changes

Published prices may change from time to time. Price changes do not apply retrospectively to packages already purchased. All pricing communications are intended to comply with the Trade Descriptions Act 2011.

5. User Obligations

As a User, you agree to:

Respect Tutors

Treat Tutors with respect and professionalism at all times. Harassment, discrimination, or abuse of any kind is not tolerated and may result in account suspension.

Safe Learning Environment

For in-person sessions at a home or chosen venue, provide a safe, quiet, and conducive learning space. Where the learner is a minor, ensure an adult is present or contactable in the residence.

Clear Communication

Communicate clearly about learning goals, the school syllabus (KPM, IGCSE/Cambridge, IB), examination targets, scheduling, and feedback after sessions.

Punctual Attendance

Be ready on time for every scheduled Tuition Session. Repeated lateness or no-shows may be subject to the cancellation charges in Section 4.

No Platform Bypass

Do not arrange or accept tuition with Tutors found through Edustar Malaysia outside of the Platform, whether to avoid fees or otherwise. Bypassing the Platform is a material breach and may result in account closure and recovery of fees.

6. Tutor Obligations

Tutors on Edustar Malaysia agree to:

Syllabus Alignment

Deliver instruction aligned to the relevant Malaysian or international syllabus (KPM / LPM for UPSR, PT3, SPM, STPM, MUET; Cambridge for IGCSE / A-Level; IB where applicable) and prepare materials suited to the learner’s level.

Professionalism

Maintain a high standard of professional conduct, including appropriate communication, presentation, and respect for the learner and everyone in the learner’s home.

Punctuality

Arrive on time, in person or online, for every confirmed session. Repeated lateness or unexplained absences may result in suspension from the Platform.

Confidentiality and Data Protection

Keep the information of the learner and of whoever registered them confidential and process any personal data strictly in line with the Personal Data Protection Act 2010 (PDPA 2010). Share learner information with third parties only with consent.

Background and Identity Checks

Cooperate with identity verification and, for Tutors teaching minors, reasonable background checks (for example, a PDRM good-conduct record where required by Edustar Malaysia). IPG-trained or equivalent teaching qualifications are recognised, and each Tutor category sets its own qualification requirement.

Independent Contractor Status

Acknowledge that Tutors engage with Users as independent contractors. Tutors are not employees of Edustar Malaysia and are responsible for their own tax obligations under Malaysian law.

7. Prohibitions

Users and Tutors are prohibited from:

Platform Bypass and Fee Avoidance

Soliciting, accepting, or arranging tuition outside the Platform with contacts first made through Edustar Malaysia, in order to avoid fees or platform protections.

Fraud and Misrepresentation

Providing false information, impersonating another person, forging qualifications, or engaging in any fraudulent or deceptive conduct.

Spam and Unsolicited Marketing

Sending spam, unsolicited advertising, chain messages, or promotional content to other Users or Tutors without consent.

Illegal or Harmful Content

Uploading, sharing, or distributing content that is unlawful under Malaysian law, infringes the rights of others, or is obscene, defamatory, or otherwise harmful.

Harassment and Unauthorised Access

Engaging in harassment, bullying, or discrimination toward any User or Tutor, or attempting to access systems, data, or accounts on the Platform without authorisation.

8. Intellectual Property

Intellectual property terms under the Trademarks Act 2019 and related law:

Edustar Brand and Platform Content

The "Edustar" wordmark, the Edustar logo, the Platform design, copy, and code are owned by Edustar Malaysia or its licensors and are protected under the Trademarks Act 2019 and Malaysian copyright law.

Tutor-Created Materials

Original teaching materials prepared by a Tutor remain the intellectual property of that Tutor. By sharing such materials through the Platform, the Tutor grants the relevant learner a limited, non-transferable licence to use them for personal study.

User-Generated Content

By submitting reviews, questions, photos, or other content to the Platform, you grant Edustar Malaysia a worldwide, non-exclusive, royalty-free licence to display, reproduce, and adapt that content for the purpose of operating and promoting the Services.

No Unauthorised Reproduction

Reproducing, distributing, scraping, or commercially exploiting Platform content without prior written permission from Edustar Malaysia is prohibited.

Feedback Licence

Feedback, suggestions, and ideas you share with us may be used by Edustar Malaysia to improve the Services without any obligation of compensation.

9. Limitation of Liability

Edustar Malaysia liability limitations, read together with mandatory Malaysian consumer protections:

"As Is" Service

The Platform and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by Malaysian law, no warranties (express or implied) are given beyond those that cannot be excluded.

Examination Outcomes

Academic results depend on many factors, including the learner’s own effort, so we do not guarantee specific UPSR, PT3, SPM, STPM, IGCSE, IB, MUET or other examination outcomes.

Independent Tutors

Tutors work with Edustar Malaysia as independent contractors. Edustar invoices the learner, pays each Tutor per validated session and arranges matching, and our responsibility does not extend to the personal conduct of Tutors or Users outside our reasonable control.

Indirect Loss

To the extent permitted by law, Edustar Malaysia is not liable for indirect, incidental, special, or consequential losses arising out of your use of the Services.

Liability Cap

Our total aggregate liability to any User in connection with the Services is limited to the fees that User has paid to Edustar Malaysia in the 12 months preceding the event giving rise to the claim.

Statutory Carve-Outs

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under the Consumer Protection Act 1999 or other Malaysian law.

10. Termination of Services

How accounts and Services may be ended:

Termination by You

You may close your account at any time through account settings or by contacting us at edustarmy@gmail.com. Outstanding sessions and obligations should be settled before closure.

Termination by Edustar Malaysia

We may suspend or close any account that breaches these Terms, behaves in a way that endangers other Users or Tutors, or is involved in fraud or unlawful conduct. Where reasonably possible, we will give notice and a chance to remedy the breach first.

Effect of Termination

On termination, your access to the Platform ends. Personal data is retained or deleted in line with our Privacy Policy and the Personal Data Protection Act 2010.

Refunds on Closure

Unused, paid sessions will be refunded in line with Section 4, except where the account is closed for breach of these Terms, in which case forfeiture may apply to the extent permitted by Malaysian law.

11. Dispute Resolution

How disputes are resolved:

Good-Faith Discussion

If a dispute arises, please contact us first at edustarmy@gmail.com. We will work in good faith to resolve the issue directly within a reasonable time.

Mediation

If direct discussion does not resolve the dispute, the parties agree to attempt mediation, including (where appropriate) through the Asian International Arbitration Centre (AIAC) in Kuala Lumpur.

Consumer Tribunal

For qualifying consumer claims, Users may also have access to the Tribunal for Consumer Claims Malaysia (TTPM) under the Consumer Protection Act 1999.

Governing Law and Jurisdiction

These Terms are governed by the laws of Malaysia, including the Contract Act 1950. Subject to the steps above, the parties submit to the exclusive jurisdiction of the Courts of Kuala Lumpur, Malaysia.

12. Changes to Terms

How we change these Terms:

Right to Update

Edustar Malaysia may update these Terms from time to time to reflect changes in our Services, our business structure, or applicable Malaysian law.

30-Day Notice for Material Changes

For material changes, we will give at least 30 days' notice by email to registered Users and by a banner on edustar.my before the changes take effect.

Acceptance by Continued Use

Continued use of the Platform after the effective date of an update constitutes acceptance of the updated Terms. If you do not agree, you may close your account before the effective date.

Latest Version

The current version of these Terms is always available on this page, with the last-updated date shown at the top of the document.
